Ukraine introduces qualifying conditions for medical cannabis use
Ukraine has taken a significant step in modernising its healthcare policies by approving a comprehensive list of qualifying conditions for medical cannabis. The list, released by the Ministry of Health, was reported at the time to include around 20 diseases and conditions for which cannabis-based medicines can be prescribed.
This comes after the medical cannabis reform law, adopted by the Verkhovna Rada in December 2023 and signed by President Volodymyr Zelensky, was officially published in February 2024 and came into effect in August 2024, marking a historic moment in the country’s medical landscape.
A regulatory framework for medical cannabis in Ukraine
Ukraine’s approach to medical cannabis regulation involves strict oversight and thorough control of the production, cultivation, and distribution processes. The Ministry of Health has established tight guidelines to ensure the safe cultivation and prescription of cannabis-based products.
Under the law, medical cannabis must be grown in "closed ground" conditions with round-the-clock video surveillance, and licensed growers must give the National Police round-the-clock access to the video surveillance data free of charge. This regulatory framework aims to maintain high standards for safety and control in the medical cannabis industry.
Qualifying conditions for medical cannabis
The law leaves it to the Ministry of Health to set the diseases and conditions for which cannabis-based medicines can be prescribed. As reported at the time, the ministry's list includes conditions such as:
- Multiple sclerosis
- Neuropathy
- Shingles
- Cerebral palsy
- Spinal cord injuries
- Complications from chemotherapy
- Parkinson’s disease
- Childhood epilepsy
- Weight loss associated with loss of appetite (anorexia) in patients with HIV-related disease
While this list covers a wide range of serious health issues, the Ministry was reported to have indicated that more conditions may be added in the future based on medical recommendations.
Strict controls on medical cannabis distribution
In addition to cultivation controls, distribution will also be tightly regulated. Under the law, pharmacies may dispense medical cannabis products only on an electronic prescription issued according to medical indications. According to reports of the ministry's announcement, they are intended to be prescribed only after conventional treatments have proved ineffective or have caused adverse reactions.
According to the Ministry, cannabis-based products will be made in pharmacy settings and available in forms like oral drops, hard capsules, and dental pastes.
Future potential for Ukraine’s cannabis market
As Ukraine continues to develop its cannabis regulation, the Ministry of Health stated at the time of the announcement that licensing conditions for the cultivation of medical cannabis were still being finalised.
The entire supply chain, from cultivation to pharmacy dispensing, will be under strict licence control, ensuring that the industry grows within a tightly monitored environment.
This emerging sector may provide opportunities for medical innovation, as well as economic benefits for Ukraine, particularly as the country becomes a more prominent player in the European medical cannabis market.
